These Terms of Service ("Terms") govern your use of PhraseJar, operated by MH Works Limited ("PhraseJar", "we", "us", "our").

By accessing or using PhraseJar, you agree to these Terms.

1. Eligibility and Account

• You must be at least 13 years old to use PhraseJar.
• You are responsible for your account credentials and all activity under your account.
• You must provide accurate information and keep it up to date.

2. The Service

PhraseJar is a language-learning support tool that helps users store phrases, generate translations and audio, and run practice sessions. PhraseJar is an educational support product and is not a substitute for formal instruction.

3. Subscriptions, Trials, and Billing

• PhraseJar may offer a free trial and paid subscriptions.
• Pricing, billing cadence, and trial details are shown in the app and may be updated over time.
• Billing and payments are handled through third-party providers (including RevenueCat and Stripe).
• You authorize us and our payment providers to charge applicable fees, taxes, and renewals unless cancelled.
• If your subscription is inactive, access to paid features may be limited.
• Except where required by law, fees are generally non-refundable.

4. Acceptable Use

You agree not to:

• use the service unlawfully or in violation of others' rights
• upload or submit harmful, abusive, or infringing content
• attempt to disrupt, probe, or bypass system security
• reverse engineer or misuse non-public parts of the service
• use automated means to abuse, scrape, or overload the platform

We may suspend or terminate access for violations.

5. User Content

• You retain ownership of content you submit (for example, phrases and custom translations).
• You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display your content as needed to operate and improve PhraseJar.
• This includes processing by our subprocessors for translation, speech generation, hosting, and billing operations.

6. AI and Generated Output

• PhraseJar may use third-party AI services to generate translations and related content.
• Generated outputs may contain errors or inaccuracies.
• You are responsible for reviewing content before relying on it.

7. Intellectual Property

• PhraseJar software, branding, and service materials are owned by MH Works Limited or its licensors.
• These Terms do not transfer ownership of our intellectual property to you.

8. Third-Party Services

PhraseJar depends on third-party services (such as Firebase, Cloudflare, Mistral, ElevenLabs, RevenueCat, and Stripe). Availability and functionality may be affected by those providers.

9. Privacy

Our handling of personal data is described in our Privacy Policy.

10. Suspension and Termination

• You may stop using PhraseJar at any time.
• You may request account deletion through the app or by contacting us.
• We may suspend or terminate access if needed for security, legal compliance, non-payment, or Terms violations.

11. Disclaimers

The service is provided on an "as is" and "as available" basis to the maximum extent allowed by law. We disclaim warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, MH Works Limited is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from or related to your use of PhraseJar.

Where liability cannot be excluded, our liability is limited to the amount you paid us for PhraseJar in the 12 months before the event giving rise to liability.

13. Indemnity

You agree to indemnify and hold harmless MH Works Limited from claims, damages, liabilities, and expenses arising from your misuse of PhraseJar or your violation of these Terms.

14. Changes to Terms

We may update these Terms. Updated Terms become effective when posted with a revised effective date. Continued use after updates means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales, excluding conflict-of-law principles. Courts of England and Wales will have jurisdiction, except where mandatory local law provides otherwise.
